These terms govern your use of the e-PT application. By installing or using the app, you agree to them. If you do not agree, do not use the app.
1. What the app is
e-PT is a client application for external quality assessment and proficiency testing programmes. It allows enrolled participants to receive shipment notifications, record proficiency testing results, and retrieve individual and summary reports.
The app does not hold your data on its own. It connects to a proficiency testing server operated by your programme, national reference laboratory, or other issuing organisation, at a server address you supply when signing in. Your use of that server, and the availability and accuracy of everything it provides, is governed by your relationship with its operator, not with us.
2. Eligibility and accounts
- Accounts are issued by your proficiency testing programme. We do not create, approve or manage accounts.
- You are responsible for keeping your credentials confidential and for all activity carried out under your account.
- You must be authorised by your organisation to submit proficiency testing results on its behalf.
- If you believe your credentials have been compromised, notify your programme administrator immediately.
3. Acceptable use
You agree not to:
- submit results you know to be false, fabricated, or not produced by the testing process the scheme requires;
- share your account with another person, or use another person's account;
- use the app to access a server you are not authorised to access, or to attempt to disrupt, overload or gain unauthorised access to any server;
- enter patient names, patient identifiers, or other personally identifiable patient information into the app.
4. Professional responsibility
e-PT is not a medical device. It is a data collection and reporting tool for proficiency testing. It does not perform, interpret or validate any diagnostic test, and nothing it displays should be used to make a clinical or diagnostic decision about a patient.
You are responsible for the accuracy and completeness of the results you enter, and for meeting the deadlines and procedures set by your scheme. Reports produced through the app reflect the data submitted to your server; verify them against your own records before relying on them.
5. Availability
The app is provided without any guarantee of availability. Its usefulness depends on a server we do not control and on your own network connectivity. Features may change or be withdrawn between releases. We may stop publishing updates at any time, though the source code will remain available under its licence.
6. Open source licence
e-PT is free and open-source software. The source code is published at github.com/deforay/ept-app under the GNU General Public License, version 3.
You are free to use, study, modify and redistribute the software under the terms of that licence, which include the requirement that derivative works be released under the same licence. Where these terms and the GPL-3.0 conflict in respect of the source code, the GPL-3.0 governs the source code.
The licence grants rights to the software. It does not grant you any right to access a particular proficiency testing server, nor any right to use the names, logos or branding of Deforay or of any proficiency testing programme.
7. Third-party services
The app is distributed through Google Play and uses Google Firebase for push notifications, crash reporting and analytics. Your use of those services is subject to Google's own terms and privacy policy. We are not responsible for third-party services.
8. Privacy
Our handling of information is described in the Privacy Policy, which forms part of these terms.
9. No warranty
The app is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of defects, or that data will not be lost.
10. Limitation of liability
To the maximum extent permitted by applicable law, the Deforay Developers Team and its contributors will not be liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of data, results, profits, accreditation status or reputation, arising out of or in connection with your use of or inability to use the app — whether or not we were advised of the possibility of such damage.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.
11. Termination
Your programme may suspend or close your account at its discretion. You may stop using the app at any time by uninstalling it. Sections 9 and 10 survive termination.
12. Changes to these terms
These terms may be updated. The current version is always published at this address with its effective date. Continued use of the app after a change takes effect constitutes acceptance of the revised terms.
